How Someone is Classified as a Sexually Violent Predator (SVP)
In Colorado, a person may be classified as a Sexually Violent Predator (SVP) if they meet certain legal requirements based on their criminal history and risk to the community.
A person can receive an SVP designation in two ways:
- Through a Colorado assessment process after a qualifying sex offense conviction
- Through a review of an out-of-state conviction if the person moves to Colorado
To be considered for SVP status, several factors are reviewed, including:
- The person’s age at the time of the offense
- The type of offense committed
- When the offense and conviction occurred
- Whether the victim was a stranger or someone the offender targeted for sexual victimization
How the Decision is Made
The assessment looks at a number of risk factors, including prior sexual offenses and the likelihood of reoffending.
This process is completed by criminal justice professionals and approved evaluators. If the person meets the required criteria, a recommendation may be made to the court or parole board for SVP designation.
The final decision is made by the court or parole board.
Please keep in mind that this agency has no legal authority to direct where a registered sex offender may reside unless there are specific court-ordered restrictions in place. If no such restrictions exist, the offender is legally permitted to live where he chooses. Sex offenders have always resided within our communities; however, law enforcement was not required to receive and maintain offender residence information until registration laws were implemented pursuant to the Jacob Wetterling Act of 1994.

Anyone designated as a Sexually Violent Predator is subject to community notification under Colorado law.
This notification may happen in different ways, including:

Information released regarding registered sex offenders and Sexually Violent Predators is intended for community awareness and public safety purposes only.
Any person who uses this information to harass, threaten, or intimidate an offender, the offender’s family or significant others, or any individual involved in the community notification process may be subject to criminal prosecution.
Acts of vigilantism will not be tolerated.
