Arrests

  1. Conspiracy 5th Degree; Criminal Possession of Stolen Property 5th Degree; Possession of a Forged Instrument; Forgery 2nd Degree; Grand Larceny 4th, 6:10 AM, Saturday, April 30, 2022, S. Main St. – ON 8/24/2022, Officer Post arrested Crystal A. MOUNTS, F/45 of Batavia, NY, on an active arrest warrant out of Batavia City Court. MOUNTS was arraigned in front of Judge BURNS of the Batavia City Court, who remanded MOUNTS to the GC Jail without bail. MOUNTS is scheduled to return to BCC on 8/25/2022 at 1:30 PM.
     
  2. Criminal Contempt 1st, 4:57 PM, Wednesday, August 24, 2022, W. Main St. – The defendant, Andrew J. DRAPER, M/43 of Batavia, NY, was charged after he was found to be in the presence of the protected party of an order of protection. He was issued an appearance ticket to appear in Batavia City Court at a later date.
     
  3. Criminal Possession of a Controlled Substance 7th Degree, 10:30 PM, Wednesday, August 24, 2022, W. Main St. – On 8/24/2022, Officer POST arrested Ricky A. MARSCEILL, M/58, of Batavia, NY, for criminal possession of a controlled substance in the seventh degree. MARSCEILL was issued an appearance ticket with a return court date of 9/13/2022 at 1:00 PM.
     
  4. Driving While Intoxicated; DWI - >.08% BAC; Driver’s View Obstructed, 1:57 AM, Sunday, August 21, 2022, E Main St. – On 8/21/2022, Joshua E. BURT, M/33 of Lyndonville, NY, was arrested after an investigation into a traffic stop, where it was alleged that he was operating a motor vehicle with a BAC of .08% or more. BURT was issued an appearance ticket and is scheduled to appear in City Court on a later date.
     
  5. Criminal Mischief 4th, 12:31 PM, Sunday, August 21, 2022, Buell St. – On 8/22/2022, Wendy L. SHAKO, F/56 of Batavia, NY, was arrested after an investigation that alleged, she smashed the rear window of a vehicle. SHAKO was issued an appearance ticket and is scheduled to appear in City Court on a later date.
     
  6. Petit Larceny, 1:37 PM, Thursday, August 18, 2022, E. Main St. – Ericc P. DOLEMAN, M/52 of Pembroke, NY, was arrested on 2 counts of Petit Larceny after an investigation into the reported shoplifting from a local business. DOLEMAN was issued an appearance ticket to return to Batavia City Court on 9/6/2022 at 1:00 PM to answer for said charges.
     
  7. DWAI Combined drugs; Failed to stop at stop sign; Criminal Possession Controlled Substance 7th; Failure to appear, 1:45 PM, Friday, April 29, 2022, Ross St. – On 8/25/2022, Kyle J. SCHROEDER, M/25 of LeRoy, NY, was arrested after an investigation into a check the welfare complaint in the City of Batavia. It was found that SCHROEDER had an active arrest warrant and pending charges for DWAI Drugs, along with Criminal Possession of a Controlled Substance in the 7th Degree. In the process of arresting SCHROEDER, he was found to have a glass pipe which tested positive for cocaine in his pocket and subsequently charged with an additional Criminal Possession of a Controlled Substance in the 7th Degree. SCHROEDER was arraigned in City Court on all charges and released on his own recognizance. SCHROEDER is scheduled to appear back on a later date.
      
  8. Failure to Appear on Appearance Ticket, 12:00 PM, Tuesday, July 5, 2022, W. Main St. – On 8/23/2022, Anthony L. VANELLI, M/45 of Batavia, NY, was arrested by Batavia Police on Batavia City Court Bench Warrant #2022-00189 after he turned himself into Genesee County Jail. VANELLI was arraigned at BCC in front of Judge ROGERS. VANELLI was held at the Genesee County Jail, VANELLI is scheduled to return to BCC on 9/14/2022 at 2:00 PM.
     
  9. Petit Larceny, 11:40 AM, Monday, August 22, 2022, E. Main St. – On 8/22/2022 at approximately 12:15PM, Jacqueline R. GARRETT, F/43 of LeRoy, NY, was arrested after allegedly stealing items from a business on E. Main St. GARRETT was issued an appearance ticket and is scheduled to appear in BCC on 9/6/2022 at 1:00 PM.
     
  10. Criminal Contempt 2nd, 2:40 PM, Monday, August 22, 2022, Vine St. – Kimberly A. FOX, F/44 of Batavia, NY, was arrested on 8/23/2022 on an arrest warrant for criminal contempt in the 2nd degree. It is alleged that FOX violated a full stay away order of protection. FOX was arraigned by Batavia City Court Judge Rogers. Judge ROGERS set bail at $1,000 A, $2,000 B, and $5,000 E. FOX is due back in Batavia City Court on 9/13/2022 at 3:00 PM.
     
  11. Harassment 2nd; Obstructing Governmental Administration; Resisting Arrest, 1:48 PM, Sunday, August 14, 2022, Liberty St. – On 8/14/2022, Gary E. JACKSON, M/30 of Batavia, NY, was arrested after an investigation into a disturbance complaint. It is alleged that JACKSON had shoved a City of Batavia Police Officer and then when he was advised that he was under arrest, JACKSON continued to resist and be combative with members of the City of Batavia Police Department. JACKSON was issued an appearance ticket to report to City Court at a later date.
     
  12. False Personation; Criminal Impersonation, 1:38 AM, Saturday, August 20, 2022, Oak St. – Tommy L. CRAWFORD, M/33 of Batavia, NY, was arrested by PO FREEMAN after allegedly giving a false name during a traffic stop on August 20th. CRAWFORD was issued an appearance ticket, and is due to appear in BCC on August 22nd. 
     
  13. Criminal Contempt 2nd, 10:30 AM, Friday, August 19, 2022, Vine St. – Kimberly A. FOX, F/44 of Batavia, NY, was arrested for two counts of Criminal Contempt 2nd after it was alleged that she yelled at two of her neighbors who both have stay away orders of protection against FOX. FOX was arraigned in Batavia City Court before Judge Rogers. FOX was released under the supervision of Genesee Justice. She is scheduled to reappear in Batavia City Court on 9/13/2022 at 3:00 PM.
     
  14. Criminal Contempt 2nd, 8:30 PM, Wednesday, August 17, 2022, Vine St. – On 8/18/222, Batavia Police executed BCC Arrest Warrant #2022-00213 and arrested Kimberly A. FOX, F/44 of Batavia, NY, for the above listed charge. FOX was arraigned in BCC in front of Judge Rogers and RUS to Genesee Justice. FOX is scheduled back in BCC on 9/13/2022 at 3:00 PM.
     
  15. Harassment 2nd, 8:53 AM, Thursday, August 18, 2022, Vine St. – On 8/18/2022, Batavia Police executed a BCC Arrest Warrant #2022-00214 on Kimberly A. FOX, F/44 of Batavia, NY. FOX was arraigned in BCC in front of Judge Rogers and RUS with Genesee Justice. FOX is scheduled back in BCC on 9/13/2022 at 3:00 PM.
     
  16. Criminal Impersonation 2nd; Bail Jumping 3rd; Bench Warrant, 1:25 PM, Saturday, August 20, 2022, Oak St. – On 8/20/2022, Tommy L. CRAWFORD, M/33 of Batavia, NY, was arrested after an investigation into a civil complaint at a local motel in the City of Batavia. It is alleged that CRAWFORD refused to pay his bill and exit the hotel room when asked by management. While City Police were investigating the complaint, it is alleged that CRAWFORD provided City Police with a false name. CRAWFORD was arrested for Criminal Impersonation 2nd and 3 bench warrants. CRAWFORD was arraigned in City Court and held with bail set at $10,000 A, $20,000 B, and $40,000 E. Along with an additional $100.00 cash bail on each warrant.
