On 05/17/2022 at approximately 9:20 AM, the Genesee County Emergency Dispatch Center received a call of a Domestic/Burglary in progress at a residence on Oak Street. The victim alleged that Gerald Brinson Jr, 33, of Rochester, had entered her residence, attacked her, and was on the run from a gun case out of Monroe County. Members of the Batavia Police Department arrived and determined the victim had escaped the residence with her 1-year-old-son, but Brinson Jr was still inside and refusing to come out. Officers from the Genesee County Sheriff's Office, NYS Police, and NYS Environmental Conservation arrived to assist. While Brinson Jr was inside the residence, he allegedly called in a fake report of gunfire on Ellicott Avenue. Eventually, Brinson Jr came out of the residence and was taken into custody.
Brinson Jr was arrested for PL 140.25 - Burglary 2nd: Dwelling, PL 155.30 - Grand Larceny 4th, PL 145.05 - Criminal Mischief 3rd, PL 265.02 - Criminal Possession of a Weapon 3rd, PL 260.10 - Endangering the Welfare of a Child, PL 240.50 - Falsely Reporting an Incident 3rd, PL 120.14 - Menacing 2nd, and PL 240.26 - Harassment 2nd. Brinson Jr also had 3 warrants; 2 out of Monroe County and 1 out of Erie County.
Brinson Jr was arraigned before City Court Judge Rogers and remanded to the Genesee County Jail on $25,0000 cash, $50,000 bond, or $100,000 partially secured bond. Brinson Jr is scheduled to re-appear in Batavia City Court on 6/14/2022 at 2 PM.
