Did you know that Georgia has a law regarding masks worn in public?
Under Georgia law (O.C.G.A. § 16-11-38), it may be a misdemeanor to wear a mask, hood, or other face covering in public if the purpose is to conceal your identity. The law applies to public property, public ways, and certain situations on private property. However, the law includes several exceptions, including masks worn for health-related reasons, workplace safety, theatrical performances, sporting activities, traditional holiday costumes, and emergency situations.
Wearing a face covering is not automatically a crime. The statute requires an intent to conceal one's identity, and the law contains specific exemptions. Georgia amended the law in 2021 to expressly protect masks worn in accordance with healthcare guidance to prevent the spread of infectious diseases.
