Pennsylvania does allow recreational commercial drone use under FAA rules.  But there are some key state laws that prohibit surveillance, contraband delivery, and use on public lands.  The FAA maintains primary authority over airspace usage, including drone operations.  All recreational drone operators must complete the Recreational UAS Safety Test.  This is a free online class through the FAA.  All drones operating in FAA airspace must be registered.

Key State Law: Title 18 subsection 3505 - Criminal offenses for

1.  Surveillance in private places - Prohibited; includes home interiors, fenced yards, changing rooms. Summary offense, up to $300 fine.

2.  Reckless Operation - No drone use that places another person in reasonable fear of bodily injury (e.g., buzzing crowds, chasing people). Summary offense, up to $300 fine.

3.  Contraband delivery - Ban on delivering contraband to inmates or to correctional facilities via drone. Second-degree felony, 5–10 years prison and/or up to $25,000 fine.

4.  Wiretap law - Two-party consent applies to drone audio recording; violations can be serious.

Public Land Restrictions:

1.  State parks:  Only 6 of 121 allow drones and only in designated areas.

2.  State Game Lands:  Total ban on all 1.5 million acres.

• Always check FAA no-fly zones and local land-use rules before flight.
• Avoid all prohibited activities under Title 18 §3505.
• For night flights, ensure FAA compliance and lighting requirements.
• Do not record audio without consent under Pennsylvania’s two-party consent law.
• Report non-compliant drones to local law enforcement PA.GOV.
