The NLCRPD responded to a series of complaints concerning sidewalks that were not cleared in accordance with Warwick Township governing ordinances requiring that property owners remove snow or ice hazards from public sidewalks traversing their property.
Upon receipt of complaints from the Warwick Township Administrative Offices , a NLCRPD patrol officer was dispatched to investigate the complaints. These complaints stemmed from snowfall on January 19th, 2020, with reporting commencing in most cases 48-72 hours after the end of the snowfall. NLCRPD made efforts to inform property owners of the requirements of the ordinance to attain voluntary compliance, including release of the specific requirements which were posted to NLCPRD.org. in the days immediately following the storm related precipitation.
As a result of the investigation a total of twelve (12) property owners were identified and cited for the offenses most of which were located in the 2000 and 2100 blocks of Main Street in Rothsville. Warwick Township ordinance § 277-32 titled Responsibility for removal of snow and ice from sidewalks. Every person in charge or control of any building or lot of land fronting or abutting on a paved sidewalk, whether as owner, tenant, occupant, lessee or otherwise, shall remove and clear away or cause to be removed or cleared away, snow and/or ice from a path of at least 30 inches in width from so much of said sidewalk as is in front of or abuts on said building or lot of land. Violations and penalties. For each violation penalties upon conviction include fines of not less than $200 nor more than $1,000 for each offense, together with the costs of prosecution. Each day or portion thereof in which a violation exists shall be considered a separate violation of this article, and each section of this article which is violated shall be considered a separate violation. In default of payment of such fine, such person shall be liable to imprisonment for a period not exceeding 30 days.
