The Craig Police Department is taking a zero‑tolerance approach to the use of fireworks this year. Due to extreme fire conditions and active fire bans throughout Moffat County, officers will be issuing citations to anyone found lighting or discharging fireworks. These restrictions are in place to protect our community and prevent potentially devastating fires.
Under Colorado Revised Statute 18‑9‑117 (Unlawful Conduct on Public Property), individuals may be cited for engaging in prohibited activities—such as fireworks use—on public property. Violations can result in legal consequences in addition to any county‑level civil penalties.
Moffat County Fire Ban Violation Penalties
Moffat County enforces penalties under CRS 30‑15‑410(1). Because the Moffat County Commissioners have adopted a specific fine schedule, violations of the county’s fire restrictions or fire bans carry the following penalties:
• First Offense: Civil fine of $250.00 dollars
• Second Offense: Civil fine of $500.00 dollars
• Third and Subsequent Offenses: Civil fine of $1,000.00 dollars
Additional consequences may apply:
• Individuals may be billed for fire suppression costs if their violation results in an escaped fire.
• If the fire causes property damage or endangers people, charges may be elevated to Reckless Endangerment or Fourth‑Degree Arson, both of which are state misdemeanors.
