Beginning June 5, 2026, drivers in Pennsylvania can be stopped and cited for using a handheld cellphone or other interactive mobile device while driving under Paul Miller’s Law. The law went into effect June 5, 2025 with violators being issued warnings for the first year. That all changes on June 5, 2026.
The law prohibits drivers from holding or supporting a cellphone or other mobile device while operating a motor vehicle — even while stopped at a red light, stop sign, or sitting in traffic.
Violations are considered a primary offense, meaning officers can stop a vehicle solely for the violation. Drivers may receive a summary citation carrying a $50 fine in addition to court costs and associated fees.
Drivers may still use hands-free technology, including Bluetooth, speakerphone functions, or devices mounted in a docking station. Phones may also be used to contact emergency responders if needed.
Distracted driving continues to be a serious safety issue across Pennsylvania. According to PennDOT, distracted driving contributed to more than 11,000 crashes statewide in 2023, resulting in 65 deaths and approximately 6,700 injuries.
