REQUEST FOR LAW ENFORCEMENT RECORDINGS - PROCESS & FEE SCHEDULE

The West Earl Township Police Department adheres to the requirements established by Act 22 of 2017 and Title 42, Ch 67A01 through 67A09. These requirements apply specifically to designated Recordings by Law Enforcement Officers within the scope of the act. In addition to the specified requirements, the WETPD is provided certain allowances in regards to requests for information not normally included within the provisions of the RTK Act. As a part of this chapter, the WETPD is permitted to establish a reasonable fee schedule for fulfillment of requests for the disclosure of recordings as permitted under the chapter, which is attached.

The WETPD process and fee schedule are as follows:

Petitioners must comply with the ACT 22 retention schedule for availability of recordings which indicates that a request for an audio or video recording in possession of a law enforcement agency must be made within 60 days of the date the recording was made

Petitioner must file a request with the Agency Open Records Officer (AORO) that complies with the requirements of §67A03 which indicates that:

1. Requests must be submitted via personal delivery or certified mail. A written request must be submitted to the Agency Open Records Officer (AORO) for the law enforcement agency that possesses the record. The request is not officially received until it is personally delivered to the AORO, or when it is marked as "delivered" by certified mail.
2. The request must include:

• The date, time and location of the event recorded;
• A statement describing the requester's relationship to the event recorded; and if the recorded incident took place inside a residence, the request must also identify every person present at the time of the recording, unless unknown and not reasonably ascertainable.

Petitioners must file a non-refundable $125 filing fee and a $200 deposit/first hour fee payable to West Earl Township upon filing of the request for disclosure. The deposit will be applied to the total costs of the agency. The fees are non-refundable regardless of the findings of the inquiry.

Upon official receipt of the compliant request, the agency has 30 days to respond. The petitioner and agency can agree to an extension, if necessary.

Videos must be reviewed by the agency to determine their eligibility for release and to identify any necessary redactions. Video requests are billed at $200 per hour for processing. The Open Records Officer will provide an itemized invoice detailing the time spent on the request before fulfilling it. If the total cost exceeds the deposit, the remaining balance must be paid before the records are provided.
