On 03/18/2024 at about 10 pm, Officer Veach responded to a fight call.
When he arrived he saw three people standing in a nearby parking lot, two females and a male. A red hoodie, a black backpack, and a handgun were seen on the ground. The two females said they were walking along Montezuma Avenue when they observed two people walking toward them on the sidewalk. As the groups were passing each other, one of the two people asked them if they were Marty. The females said that they were not, and that they didn't know anyone by that name.
As the young women continued walking, the person dressed in red started following them, accusing them of being Marty. They were getting scared and asked the person to leave them alone.
The person was later identified as Emmery Whiteskunk by an identification card found in the pocket of the red jacket. Emmery became aggressive and grabbed one of the women by her coat and pulled her to him until they were face to face. The other female separated the two in an attempt to de-escalate the situation. As she separated the two, Emmery head-butted the victim and began punching her. The other victim called police.
The young lady became fearful for her life and pulled out her .9mm handgun telling Emmery that she had a gun and that she would shoot him if he didn't stop. Emmery continued to strike her in the face. The victim hit Emmery with the handgun a couple of times and begged him to stop attacking her.
Emmery then stated that he had a gun too and began reaching for his backpack. The female feared that he would grab his gun and kill her. She grabbed Emmery's bag and placed her gun point blank at his stomach. She then moved her gun away from Emmery's body and fired her gun intentionally missing Emmery. The suspect slipped out of the jacket that was tangled with the backpack and ran away. The victim held onto the bag, believing that there was a firearm in it. Officer Sharp spoke with the male witness on scene who told him the same thing the females had said.
On 03/19/2024 at 5:30 am, dispatch received a call from the Bridge Shelter assisting Emmery in reporting the injuries.
Emmery reported that a random woman grabbed his backpack and began attacking him. As the woman attacked him, she pulled out a handgun, struck him on the head twice, and shot at his head. Emmery claims that he was able to avoid the bullet and run away. I explained that I had the evidence and a witness who stated that he was the aggressor.
He was handcuffed without incident and transported to the emergency room due the reported injuries. While at the emergency room, a nurse began cleaning the injuries to his head and saw two different cuts about an inch long that were on a sizable bump. The injuries are consistent with the victim's statements.
Once medically cleared Emmery was transported to the Montezuma County Jail and charged with Menacing, Assault in the Third Degree, and Harassment.
