Robert Lee Eberly, 74, of Denver, PA, was charged with Accidents Involving Damage to Unattended Vehicles or Property, Driving Under Influence (refusal) and a summary traffic violation after an officer witnessed a crash in the 1st block of South Muddy Creek Road, on 27 June 2023, at approximately 2245 hours.  An officer witnessed him veer off the roadway, striking a speed limit sign, breaking the sign off at the base.  He did not stop and continued as an officer activated their emergency lights and siren.  He pulled into a driveway about a quarter of a mile away and officers determined he was impaired, and he was arrested.  He refused a breath test and was sent a summons to appear in District Court.   If convicted of DUI, he faces enhanced criminal penalties for refusing to submit to a breath test, according to the Pennsylvania Implied Consent Law.
