A Warrington man was sentenced Friday to serve three to six years in state prison for sexually assaulting a 13-year-old boy he had lured to a Solebury Township park.
Nicholas Fischer, 22, of Kennedy Court, pleaded guilty July 14 to involuntary deviate sexual intercourse with a person less than 16 years of age, statutory sexual assault and criminal use of a communication facility.
Bucks County Common Pleas Court Judge Diane E. Gibbons imposed the sentence, which had been recommended to her after negotiations between Deputy District Attorney Kate Kohler and defense attorney Thomas Logan. In addition to the prison time, the sentence called for a consecutive five years of probation.
According to court records, Fischer and the victim had met online on a social media site called Grindr and had exchanged cell phone numbers. The boy told police that Fischer suggested several times that they meet in person.
Although reluctant at first, the boy said he agreed to meet with Fischer on Jan. 28 at Pat Livezey Park in Solebury, where they performed oral sex on each other.
“He knew that our son was only 13 years old and he manipulated, lured and assaulted him,” the victim’s mother wrote in a statement read in court by Kohler.
The mother wrote that she now is afraid to let her son go out with friends or be out of her sight or contact by phone.
“I give him far less freedom now and I have become obsessed with keeping track of his every move,” the victim’s mother wrote. “Our relationship is certainly strained because of this. My entire family’s ability to live happy and carefree is now completely gone because of [Fischer].”
Fischer, who is undergoing sexual addiction treatment, told Gibbons he was “truly sorry that I made the terrible decision to do this. I’m at a loss for words. I can’t even imagine what [the boy and his family] are going through.”
As a condition of Fischer’s probation, Gibbons ordered that he have no unsupervised contact with anyone under age 18. Although not found to be a sexually violent predator by the Pennsylvania Sexual Offenders Assessment Board, Fischer will have to register as a sex offender for the rest of his life.
The case was investigated by Solebury Township Police Detective Cpl. Jonathan M. Koretzky, and prosecuted by Kohler and Deputy District Attorney Chelsey D. Jackman.
