On July 27, 2016, at approx. 10:13 PM, Officers Ryan Burgett and Austin Krause were handling an assault call in the 500 block of Lafayette Street when they heard several gunshots being fired from the area of the 500 block of Manor Street, less than a block away. The officers immediately went to the 500 block of Manor Street to investigate and observed two male subjects running north on Filbert Street from Manor Street and then observed another male running from Manor Street onto Filbert Street. The third subject was carrying a handgun and continued running north and then turned west on Filbert Street. When the officers reached Filbert Street, they lost sight of the subject with the handgun in the area of 23 W. Filbert Street. While the officers were trying to locate the suspect, they heard additional gunshots being fired and heard bullets going over their heads. The officers immediately sought cover. The officers were unable to determine who had fired the shots in their direction. The officers then observed that the male who had disappeared from sight step out where the officers could see him. The officers ordered the male onto the ground and were able to take him into custody without incident. The suspect, a 17-year-old Lancaster male, was then transported to the Lancaster City Police station. The officers immediately secured the area and began searching for additional suspects and evidence.
Other officers who responded to assist located a 13-year-old male victim in the area of Filbert Street and Campbell Ave with a gunshot wound to the leg. The victim was transported to an area hospital by ambulance, where he is being treated for a non-life threatening leg injury. Investigators learned that the victim had been walking in the area with a juvenile family member and that they were most likely the two subjects initially seen running north on Filbert Street by the officers. Investigators do not believe that the 13-year-old victim was the intended target and the incident does not appear to be a random act. Based on the investigation, the 13-year-old shooting victim also does not appear to be involved with the shots being fired in the direction of the officers.
After a search of the area, no additional suspects were located, but numerous bullet casings were found at the scene. Investigators interviewed witnesses and processed the scene for evidence. Investigators located a Bersa .380 caliber handgun behind a parked vehicle near 19 W. Filbert Street, in the area where pursuing officers lost sight of the 17-year-old. The handgun was determined to be have been reported stolen from North Carolina. The juvenile suspect was charged with one count of Receiving Stolen Property (F-2), one count of Possession of Firearm by Minor (M-1) and one count of Loitering and Prowling At Night Time (M-3) by Detective Lieutenant Kevin Fry before Lancaster County Juvenile Probation. He is being detained at the Lancaster County Youth Intervention Center.
Fortunately, Officer Burgett and Officer Krause were not injured during the incident and continue to work their patrol assignments.
