A former Lancaster City Bureau of Police Officer will face two additional sexual assault charges in the Pleas following a preliminary hearing before Magisterial District Judge Courtney Monson Tuesday afternoon in the Lancaster County Courthouse.
Andrew Scott Selby, 54 of the 700 block of Baumgardner Road, had charges against him of attempted rape and attempted statutory rape bound over to the Lancaster County Court of Common Pleas following Tuesday’s hearing.
The two newest charges are alleged to have occurred at a residence in the 600 block of Martha Avenue, Manheim Township.
Assistant District Attorney Elizabeth Lapp presented evidence during the preliminary hearing from a victim who testified she was sexually assaulted by a man when she was 13 years old while spending the night at an acquaintance’s house.
The victim stated she got up during the night to use the bathroom and passed the man, who asked her to come and sit with him. The victim testified she declined before the man forcibly pulled her onto her lap and sexually assaulted her.
The acquaintance also testified during the proceeding and stated Selby, who she identified and pointed out during the proceeding, was present and the only other adult in the house the night of the incident.
Defense counsel argued that the witnesses had two different recollections of events and that they couldn’t identify his client.
MDJ Monson dismissed charges of rape and statutory rape at the conclusion of the hearing.
MDJ Monson did not modify bail amount ($1 million) and ordered a no-contact provision for the acquaintance witness.
Selby is already facing charges alleged to occur in Lancaster city of rape of a person less than 13, two counts of rape, involuntary deviate sexual intercourse of a person less than 13, three counts of sexual assault, statutory sexual assault, attempted rape, attempted involuntary deviate sexual intercourse, attempted sexual assault, and attempted statutory sexual assault.
All those charges were bound over to the Court of Common Pleas following a preliminary hearing before Magisterial District Judge Jodie Richardson on June 7, 2024.
Bail was set at 10% of $50,000 ($15,000 total) on each of the three charges of rape, statutory sexual assault, and sexual assault after a bail hearing June 21 by Chester County Senior Judge William Mahon, who was appointed by the Pennsylvania Supreme Court to oversee Selby’s cases due to a conflict of interest with Lancaster County Court of Common Pleas judges.
Selby is being held in Chester County Prison on $500,000 bail on the rest of the remaining charges.
All defendants are presumed innocent until proven guilty.
