A New Providence man will face homicide by vehicle while DUI and related charges in Lancaster County Court after he waived a preliminary hearing Monday before Magisterial District Judge William Mankin.
David Whisman, 42 of the 300 block of Hollow Road, is charged with causing a fatal crash while under the influence of fentanyl that killed 86-year-old Frank Cascarella and injured another victim on Christmas Day in 2022.
Whisman is also charged with homicide by vehicle, aggravated assault by vehicle while DUI, aggravated assault by vehicle, three counts of DUI, possession of a controlled substance, possession of drug paraphernalia, and a summary driving offense.
A motorist alerted a Pennsylvania State Police Trooper conducting nearby patrol operations of a vehicle crash on Dec. 25, 2022, at approximately 5:30 p.m. near PA 272, just south of Truce Road, Providence Township.
The trooper responded to the scene and observed what appeared to be a head-on crash with a white Nissan Sentra and dark Honda Odyssey minivan each with heavy front-end damage.
The trooper observed within the Nissan Sentra two glass smoking devise containing suspected drug residue lying on the driver’s side floorboard, three glassine baggies, and an opened/empty yellow plastic sleeve marker “Buprenorphine and Naloxone Sublingual Film – 8mg” with Whisman’s name on the prescription label.
Whisman later admitted to smoking fentanyl to the trooper and consented to a blood draw that showed fentanyl in his system.
Cascarella died on Jan. 12, 2023, with the Lancaster County Coroner’s Office listed the cause of death to be multiple traumatic injuries due to motor vehicle accident and the manner as accidental.
The second victim suffered a right subdural hematoma, a seven-inch laceration to her left knee, and a laceration to her liver.
Subsequent tests on Whisman’s Nissan Sentra showed no mechanical defects that would have contributed to the crash. There were no roadway defects or adverse weather conditions that would have contributed to the collision.
All defendants are presumed innocent until proven guilty.
