A Lancaster man will serve up to a decade in prison for pulling a gun during a domestic altercation in 2018 – when he was on parole and prohibited from having a firearm.
Francis Cruz-Rivera was sentenced to 4½ to 10 years for the person not to possess conviction, and he faces additional penalty regarding the state parole matter.
On Tuesday, Lancaster County Judge Donald Totaro ordered the maximum (minimum) sentence as outlined in state sentencing guidelines. Judge Totaro said Cruz-Rivera’s criminal conduct while on parole indicates he is not amenable to supervision.
Assistant District Attorney Lance Greene credited the female victim for her strong testimony at trial in December and her courage throughout the course of the prosecution.

The woman called Cruz-Rivera’s parole officers after he pulled the pistol on her - with two children in the vehicle's back seat, according to testimony.
Cruz-Rivera, 49, is on state parole for a felony aggravated assault conviction.
Judge Totaro also recommended that Cruz-Rivera comply with domestic violence conditions. (State parole will ultimately decide the conditions.)
Lancaster city police Officer Ziki Skatz filed charges.
