A Lancaster man charged with criminal homicide waived his preliminary hearing Thursday afternoon before Magisterial District Judge Jodie Richardson at the Lancaster County Courthouse.
Terrance McCain Jr., 37 of the 300 block of Laurel Street, will face charges of first-degree murder, third-degree murder, and recklessly endangering another person in Lancaster County Court.
McCain Jr. will be arraigned December 8 at 9 a.m.
McCain Jr. is charged with shooting and killing Edward Gardner in the 900 block of S. Duke St. after both were present at Joe Capps Bar.
On September 30, 2023, at approximately 1:19 a.m., the Lancaster City Bureau of Police was dispatched to the area for a shooting with the victim sustaining two gunshot wounds to the torso.
Officers learned from witnesses, video footage, and social media that the shooter was McCain Jr.
Video evidence shows McCain Jr. entering a vehicle and appears to retrieve an object from the center console. McCain Jr. and the victim engage in a verbal altercation and McCain Jr. keeps his left hand in his sweatshirt pocket.
McCain Jr. then turns his back to the victim, removes a handgun from his left pocket, loads it, and turns back to the victim. Once the defendant gets approximately 10 feet from the victim, he removes the firearm and discharges three rounds at the victim.
McCain Jr. turned himself in at the Lancaster City Police Station October 3.
All defendants are presumed innocent until proven guilty.
Assistant District Attorney Christine Wilson is prosecuting the case.
Lancaster City Bureau of Police Detective Ryan Burgett filed charges.
