An East Hempfield Township man accused of stabbing two siblings, killing one of them, will have his case proceed to county court after he waived his preliminary hearing before Judge Brian Chudzik today.

Benjamin Garcia Gual, of the 2600 block of Scenic Drive, will stand trial in the Court of Common Pleas on charges of criminal homicide, attempted criminal homicide, aggravated assault, possession of an instrument of crime, and recklessly endangering another person.

Garcia Gual, 49, is accused of stabbing siblings Carmen and Luis Martinez-Silva at a residence in the 2900 block of Dell Lane in Lancaster around 1:40 p.m. on Nov. 3.

Police arrived at the scene to find both victims having suffered multiple stab wounds and Garcia Gual inside a vehicle with a kitchen knife.

First responders performed lifesaving measures on Carmen Martinez-Silva but were unsuccessful.

Luis Martinez-Silva survived the incident with multiple stab wounds throughout his body including to the base of his skull, his chest, his abdomen and his left arm.

Carmen Martinez-Silva’s daughter told police her mother had spent the night at the Dell Lane residence because she was “scared” of Garcia Gual, with whom she was involved in a romantic relationship. Garcia Gual had earlier been angered and threatened to stab Carmen Martinez-Silva over her recent haircut, her daughter told police.

A witness told police Carmen Martinez-Silva had asked him to tell Garcia Gual that their relationship was over and attempted to conceal her location, but Garcia Gual arrived at Dell Lane and began stabbing Luis Martinez-Silva.

Garcia Gual stabbed Carmen Martinez-Silva when she attempted to pull him away from her brother, an eyewitness told police. Garcia Gual also attempted to swing the knife toward two other people present at the incident but missed both times.

First Assistant District Attorney Travis Anderson will prosecute the case.

Charges were filed by Officer Tyler Clisham of East Hempfield Township Police Department.

All defendants are presumed innocent until proven guilty.
