A Lancaster County jury convicted a Martic Township man of raping an intoxicated underage girl on a Susquehanna River island following a five-day trial.
The jury found Salvador Villa-Del Toro, of the first block of Old Holtwood Road, guilty on Sept. 24 of one count of rape of an unconscious victim, two counts of indecent assault, two counts of aggravated assault, corruption of minors, sexual assault, unlawful contact with a minor and failure to register an automobile.
Villa-Del Toro, 28, raped the victim on an unknown Susquehanna River island in Martic Township in July 2024.
The 17-year-old victim testified that she and some friends were drinking at the river’s shoreline when Villa-Del Toro arrived with a jet ski, offering to take her out on a ride. When Villa-Del Toro had her alone he then raped her, she said, despite her being in and out of consciousness and unable to consent to sex.
When the victim returned with Villa-Del Toro about an hour later her friends immediately suspected something was wrong as she could barely stand or walk, she testified. Police were called to the scene for a report of a possible overdose after the victim’s friends believed she had been drugged.
Troopers were unable to speak to the victim at the time due to her condition and she was instead taken to a local hospital.
A vaginal swab taken from the victim matched Villa-Del Toro’s DNA.
Though Villa-Del Toro initially denied having sex with the victim, he later admitted to having what he described as a consensual sexual encounter with her when he dropped her off near a swimming hole. Villa-Del Toro was aware that the victim was intoxicated at the time.
The jury returned a guilty verdict on all charges after about an hour of deliberation.
Judge Todd Brown, who presided over the trial, is scheduled to sentence Villa-Del Toro at a later date.
Assistant District Attorney Fritz Haverstick prosecuted the case.
Pennsylvania State Police Trooper Jonathan Lear filed the charges.
