A city man charged with kidnapping an unconscious woman from a downtown bar and raping her will have his case proceed to county court following a preliminary hearing earlier this month.
Judge Andrew LeFever ruled June 9 that the case of Ronald Neal Shubert, of the 800 block of North Queen Street, could proceed to the Court of Common Pleas on charges of rape of an unconscious victim, aggravated indecent assault, sexual assault, indecent assault, kidnapping, unauthorized use of a motor vehicle, two counts of accessing a device without authorization, one count each of receiving stolen property and tampering with evidence, two counts of theft by unlawful taking and a single count of driving with a suspended license.
Shubert, 58, is accused of raping the victim during the early morning hours of Jan. 9.
The victim told police she awoke in her vehicle in the parking lot of a gas station in the 100 block of West Orange Street around 6 a.m. not wearing any pants and covered in vomit.
Surveillance footage from the Lancaster Safety Coalition and private security cameras purports to depict Shubert approaching the victim and another woman as they departed a downtown bar around 2 a.m. and guiding them to the victim’s vehicle. Shubert can be seen in the footage driving the victim’s vehicle and dropping the other woman off before entering the gas station parking lot shortly before 3 a.m.
Footage then purports to show Shubert entering the gas station and making a purchase using the victim’s credit card.
In an interview with police Shubert admitted to having kissed and having sex with the victim despite her being so drunk that she was unable to speak and vomited on herself. Shubert also admitted to having used the victims’ credit cards to make purchases at the gas station and a McDonald’s without her permission.
Shubert remains in Lancaster County Prison in lieu of $250,000 bail.
Lancaster City Bureau of Police Officer Harry Valverde filed the charges.
Assistant District Attorney Fritz Haverstick will prosecute the case.
All defendants are presumed innocent until proven guilty.
