A Lancaster city couple charged with severely injuring a 3-month-old baby during a fight will have their cases proceed to county court after waiving their preliminary hearings.
Kimberlyn Videa-Dubon and Luis Reyes-Pagan waived their preliminary hearings before Judge Adam Witkonis on April 27 on charges of aggravated assault, endangering the welfare of children and attempted simple assault. Videa-Dubon is also charged with a single count of harassment.
Videa-Dubon, 30, and Reyes-Pagan, 46, are accused of injuring the infant during a fight at their shared residence in the 600 block of Union Street during the early morning hours of Feb. 15. The infant was hospitalized with a skull fracture and brain bleeding as a result of assault.
In interviews with police Reyes-Pagan and Videa-Dubon stated that they were arguing with one another around 3:30 a.m. when, according to Reyes-Pagan, Videa-Dubon struck him multiple times while she held the infant. When Reyes-Pagan attempted to punch Videa-Dubon in return he instead struck the infant in the head, they said.
A bystander was struck in the face by Videa-Dubon when they attempted to intervene in the altercation. Videa-Dubon told police that Reyes-Pagan also broke her phone during the scuffle.
Though he admitted to police that his actions were reckless, Reyes-Pagan insisted that his actions were provoked by Videa-Dubon.
Both Videa-Dubon and Reyes-Pagan are currently free on $50,000 unsecured bail.
Lancaster City Bureau of Police Det. Karson Arnold filed the charges.
Assistant District Attorney Elizabeth Lapp will prosecute the case.
All defendants are presumed innocent until proven guilty.
