Commonwealth v Dana Nunnally: Dana Nunnally was convicted by a Dauphin County jury on Wednesday, January 13, 2016 of Simple Assault and Possession of Drug Paraphernalia. Furthermore, Dauphin County Judge William T. Tully found him guilty of Possession of a Small Amount of Marijuana arising from the same incident.
On June 9, 2015, Nunnally was in his kitchen smoking marijuana with his daughter. The victim, Nunnally's girlfriend, became upset about Nunnally and his daughter smoking marijuana. Her objection to the marijuana smoking led to a verbal argument between Nunnally and the victim. Nunnally confronted the victim about her objections and asked her, "You got anything to say?" The argument quickly escalated and Nunnally put the victim in a headlock and repeatedly punched her in the head causing multiple lacerations with blood. The victim reported to the police that Nunnally's daughter was standing nearby, laughing, while Nunnally assaulted her. The victim got away, ran onto the porch, and called 911. She remained on the porch until the police arrived. Pursuant to a search incident to the arrest, Harrisburg City Police Officer Garrett Miller found a plastic baggie with a small amount of marijuana inside of it.
This case was prosecuted by Deputy District Attorney Stephen I. McLendon.
