We are grateful for today's decision made by the Appellate Division of the New York Supreme Court affirming the decisions made in Broome County Court regarding the conviction of Kenneth Weber in the 2015 killing of his grandmother, Saundra Stabler.
Prior to his plea and conviction, Weber contended that his statements to the Vestal Police admitting to causing the death of Stabler, were involuntary because he needed immediate medical attention, he also asserted that the initial search of Stabler's home by the Vestal Police was improper.
These issues were addressed in Broome County Court by Judge Northrup during a Suppression Hearing. At that time Judge Northrup determined that these claims were not valid and his statements were not suppressed.
Weber's appeal was an attempted to contend these points once again, adding that his sentence (to which he agreed upon) was unduly harsh or severe, requesting a reduction.
Thankfully the Appellate Division has also rejected these claims and today affirmed the decisions made in Broome County Court. As a result, Weber will stay where he belongs.
Today our thoughts are with the still grieving family and friends of Saundra Stabler.
