On Thursday March 14, 2019 at approximately 0157 hrs. Officers from Lancaster Bureau of Police Platoon B, responded to the area of E. Fulton St. and N. Christian St. for a report of a fight in-progress. The dispatcher at 911 heard (4) gunshots in the background of the call just before in ended.
Officers arrived in the area but did not locate anything in the area of the original call. Officers continued to check the area as a large number of people were leaving the Village nighclub at the time of the fight call and when Officers arrived in the area.
Off. Gunnet was driving north on the 100 blk. N. Queen St. when he observed several people engaged in a fist fight in the intersection of Chestnut St. and N. Queen St. Off. Gunnet notified other Officers via radio and exited his patrol vehicle to break up the fight. As additional Officers arrived in the area a single gunshot was heard as it was fired near the intersection of Chestnut St. and N Queen St.
Off. Parr observed a male that reportedly fired the shot as the male ran south on the 100 blk. N. Queen St. Off. Heckman and Off. Detwiler had just arrived on 100 blk. N. Queen St. and attempted to stop the male. The male ran across to the east side of N. Queen St. The Officers saw that the male's hands went down to his waistband and he ducked behind a light pole. The Officers heard the sound of a metallic object as it was dropped on the ground. The male walked back out into the street towards Officers and was stopped and secured at that location. Officers checked the area where the male had stopped behind the pole and located a .45 caliber semi-automatic handgun on the ground.
The male that had fired the shot and discarded the handgun was identified as Robert Waters III M/25 of Millersville, PA. Waters had scrapes on his knuckles and an injury to his mouth. It is unknown if Waters received those injuries as a result of an earlier fight or when he fell on the ground as he ran from the scene of Chestnut St. and N. Queen St. before he was stopped by Officers.
Waters reportedly retrieved his handgun from his vehicle as it was parked along Chestnut St. near Queen St. Waters reportedly fired a single shot in the air after the fight was observed at that intersection. The handgun was owned by Waters and he does have a permit to carry a handgun in concealed fashion.
After consultation with an on-call Asst. District Attorney it was decided that Waters would be charged with (1) count Recklessly Endangering Another Person (M2) and Discharge of Firearms (S) (Lancaster City Ordinance). A Criminal Summons will be sent to Waters. He was released from the station shortly after 1100 hrs.
(2) others that had been involved in the fight at N Queen St. and Chestnut St. were arrested by Officers that had responded to the scene. Duante Jordan M/24 500 blk. Dauphin St. and Nyree Terrell M/22 400 blk. New Dorwart St. were both charged with Disorderly Conduct (S) and Public Drunkenness (S). they were both released later that morning.
All persons accused of a crime are presumed innocent unless proven guilty in court.
