A New Holland man charged with killing a 2-month-old girl will have his case proceed to county court after stipulating to a prima facia case based on the Commonwealth’s allegations earlier this week.
Judge Jonathan Heisse ruled on Monday that the case of David Lee Souden, 47, could proceed to the Court of Common Pleas on charges of third-degree murder, aggravated assault and endangering the welfare of children.
That ruling came after Souden stipulated to the Commonwealth’s allegations that he assaulted the infant at his residence in the first block of Wecaf Road the afternoon of Feb. 1.
Police found the baby unresponsive shortly after 5:30 p.m. The baby was flown to an area hospital where she died of her injuries on Feb. 5.
In an interview with police Souden admitted to shaking the infant in a fit of anger when she began crying, causing her head to snap back and forth until she became limp. After being shaken the baby she had a blank stare in her eyes and began turning different colors, Souden told police.
Believing he had killed the girl, Souden abandoned the baby and walked out of the house, leaving her to die, he said. Souden admitted to police that he made no attempts to call 911 or anyone else to give the infant medical attention.
About an hour and a half later Souden surrendered himself to police, telling them he needed to report killing the infant.
Souden remains in Lancaster County Prison without bail due to the severity of the offenses.
New Holland Borough Police Det. Heather Halstead filed the charges.
Assistant District Attorney Elizabeth Lapp will prosecute the case.
All defendants are presumed innocent until proven guilty.
