The rise in popularity of these air-powered toy guns, which shoot gel beads, has increased safety concerns. Despite their toy-like appearance, these devices can be mistaken for actual firearms and have been linked to reckless and dangerous behavior in public spaces.
York City’s Ordinance on Air Rifles and Similar Devices
Under Article 733.01 of the York City Code, it is illegal to sell, possess, or use any air rifle or similar device, including Orbeez air rifles, within city limits. The ordinance states:
"No person, firm or corporation shall store, sell, offer or expose for sale, at retail, or have in their possession with intent to sell, at retail, or with intent to use within the City limits any air rifle or air pistol, commonly known as a B-B gun, sling shot or any similar device."
Furthermore, Article 733.02 authorizes the Chief of Police to seize and destroy any air rifle or similar device found in violation of this ordinance.
Public Safety Risks and Law Enforcement Action
Law enforcement officials are particularly concerned about the misuse of Orbeez air rifles in public settings, where their resemblance to real firearms can cause alarm and pose a risk of escalation with police officers or the public. There have been reports in various cities of individuals using these devices to harass pedestrians and law enforcement.
The public needs to understand that these air rifles are not harmless toys. Beyond the physical injuries they can cause, they also create confusion and panic in public spaces. If you are caught with one in the city, it will be confiscated, and you may face legal consequences.
Community Call to Action
The police department urges parents and guardians to educate their children about the dangers and illegality of Orbeez air rifles. Residents who witness the possession or use of these devices are encouraged to report violations to the York City Police Department immediately.
