Two convicted rioters recently had their appeals denied by the Pennsylvania Superior Court for their roles in the riots at the Lancaster City Bureau of Police station on September 13 into September 14, 2020.
The convictions for Dylan Davis, 31, and Taylor Enterline, 24, will remain. Davis and Enterline are both serving three-year probation sentences.
Davis argued he was not violent at the riots and that the “convictions arose solely from his presence at the scene of the crime.”
The court found that Davis’s “confederation with the front line of rioters, opposing law enforcement’s efforts to disperse the crowd, evidenced his agreement to participate in the riot.”
Furthermore, the court found Davis’s “arm motion directing the crowd toward the police line demonstrated his active participation in the tumultuous conduct of the group.”
Enterline argued she “protested peacefully” and presented evidence of her peaceful intent during the riots.
The court found that while Enterline insisted she had “peaceful” intent, “the charges carry no requirement that she act with violent intent.” Disorderly conduct requires only that Enterline intended or recklessly created the risk of public inconvenience.
The court further noted her conduct during the riots to include:
-blocking traffic from driving down West Chestnut Street by sitting in the crosswalk
-leading chants of the crowd with a megaphone, including “F*** the Police!” and “F*** 12!”
-joining the mob as it advanced up the Lancaster City Bureau of Police ramp
-donning goggles to march through the police’s first deployment of chemical ordinances while exclaiming, “We’re not going anywhere!”
-failing to disperse from the area even after being pushed back by police down West Chestnut Street to the intersection
Davis was convicted by Lancaster County Judge Merrill Spahn following a bench trial on Nov. 7, 2022, of riot, criminal conspiracy, failure to disperse, obstruction of highways, disorderly conduct, and dangerous burning.
Davis was sentenced on Feb. 3, 2023.
Enterline was convicted by jury on Jan. 19, 2023, of riot, failure to disperse, obstructing highways, disorderly conduct, and defiant trespass.
Enterline was sentenced on April 4, 2023.
