On May 29, 2023 at 2:22 PM, a Lower Allen Township Police Officer was patrolling the Capital City Mall parking lot and observed a black Honda Civic with blacked out tint on all windows. The vehicle had what appeared to be a temporary tag with the first character obscured by a black mark. While observing the vehicle, a white female, later identified as Kristina Borbon, exited the passenger side of the Honda on her phone and went to the trunk.
Capital City Mall Security was alerted to possible suspicious activity and was requested to watch the vehicle. Borbon then moved the vehicle from the Macy's rear lot to the food court lot with a different license plate on the vehicle. Borbon exited the Honda and entered the Capital City Mall. A dark grey Nissan (also with illegal window tint) then pulled up next to the Honda. Both vehicles were continued to be observed.
After the Nissan parked, a black male, later identified as Leroy Armstrong, Jr, exited, then walked around the exterior of the mall to the food court. While this was happening, Borbon, who was on the phone the entire time, met Armstrong. Armstrong returned to the Honda, moved it to the west side of the parking lot and pulled in next to the Nissan. He was observed removing a license plate from the backseat and attaching a New York license plate to the front of the vehicle. He was observed walking around the exterior of the mall and back to the food court again.
While Armstrong was moving the Honda, Borbon was observed still on the phone the entire time walking through the mall and eventually into Macy's from the mall interior, remaining in Macy's for several minutes. Armstrong located Borbon inside the mall after she exited Macy's. Both returned to the Honda and the Nissan. Borbon got into the driver's seat of the Honda, Armstrong was observed collecting a white plastic bag and a black and red bag from the Honda's back seat, which he put in the trunk of the Nissan. He got into the driver seat of the Nissan.
Both waited several minutes, then Borbon left the mall lot exiting on Lower Allen Drive. A few moments later, Armstrong left the parking spot heading east through the mall property. He returned to the same Macy's rear parking lot and parked in the same spot the Honda was in when I first observed it. He did not exit the vehicle, but waited a few moments, then began to pull out of the spot. A white male, later identified as Anthony Vasquez, wearing a surgical facemask, light colored hat, black t-shirt, black Adidas pants with white stripes and light sneakers, quickly exited Macy's and ran to the passenger side of the Nissan, getting in while it was still moving.
Officers made contact and detained both males. Additional units located Borbon in the Honda in a parking lot on Gettysburg Rd. It was later confirmed that a Macy's associate observed a male wearing all black with a facemask appearing to conceal merchandise in a suitcase. All were advised they were under arrest for criminal conspiracy to commit retail theft. The total value of the merchandise Vasquez had concealed was $5,080.
Borbon, Vasquez, and Armstrong were transported to CCP.
